Terms of Service

These terms govern your use of Super44, the AI assistant for local business owners. They're a contract between you and Super44 GmbH. We've written them in plain language, but they are legally binding — please read them.
Agreeing to These Terms
By creating a Super44 account or using the app, you agree to these terms. If you're using Super44 on behalf of a business, you confirm that you have the authority to bind that business to these terms. If you don't agree, please don't use the service.
What Super44 Does
Super44 is an AI-powered assistant that helps local business owners understand their sales, reviews, and operations through a chat interface. The service includes:
- AI chat — ask questions about your business in plain language and get answers based on your data
- POS integration — connect your point-of-sale system so Super44 can analyze your sales, costs, and trends
- Google review monitoring — connect your Google Business Profile to track and respond to customer reviews
- Insights and suggestions — Super44 surfaces patterns, flags issues, and suggests actions based on your data
Your Account
You need an account to use Super44. You're responsible for keeping your login credentials secure. If you suspect unauthorized access, let us know immediately at hello@super44.ai. You must provide accurate information when creating your account, and you may only create one account per person.
AI-Generated Content
This is important: Super44 uses AI (powered by Anthropic Claude) to generate responses, insights, and suggestions. While we work hard to make the AI helpful and accurate, you should know that:
- AI responses are suggestions, not professional advice. They are not a substitute for professional financial, legal, tax, or business consulting.
- AI can make mistakes. Responses may be inaccurate, incomplete, or out of date. Always verify important decisions with your own judgment and professional advisors.
- AI responses are based on the data you provide. If your POS data or business information is incomplete or inaccurate, the AI's output will reflect that.
- We don't guarantee specific business outcomes. Super44 is a tool to help you make better-informed decisions, not a promise of increased revenue or reduced costs.
You are ultimately responsible for any business decisions you make, whether or not they were informed by Super44's suggestions. In accordance with the EU AI Act (Article 50), we want to be clear: when you use the Super44 chat, you are interacting with an artificial intelligence system, not a human. The underlying AI model is provided by a third party (Anthropic Claude, hosted on AWS Bedrock in the EU). Super44 does not control the AI model itself and cannot guarantee its outputs.
Third-Party Integrations
Super44 connects to third-party services like your POS system and Google Business Profile. A few things to keep in mind:
- You authorize these connections. When you connect an integration, you're giving Super44 permission to access the relevant data from that service.
- We're not responsible for third-party services. If your POS provider has an outage or Google changes their API, that may affect Super44's functionality. We'll do our best to work around issues, but we can't control external services.
- You must comply with third-party terms. Your use of connected services is also governed by their own terms. Make sure you're allowed to share the data you connect with Super44.
- You can disconnect at any time. Removing an integration stops data syncing. You can also request deletion of previously synced data.
Pricing and Billing
Super44 offers both free and paid plans. Paid subscriptions are billed through the Apple App Store or Google Play Store, and those platforms' billing terms apply. We're building Super44 for business owners who get real value from it — if you feel you're not getting value from a paid plan, reach out to us at hello@super44.ai and we'll make it right. We may change our pricing in the future, but we'll always give you advance notice and the option to cancel before any price change takes effect.
Your Data and Content
Your business data belongs to you. When you upload data or connect integrations, you keep full ownership of that data. You grant Super44 a limited license to use your data solely to provide and improve the service for you. We won't sell your data, use it to train AI models, or share it with third parties for their own purposes. When you delete your account, we delete your data — see our Privacy Policy for the specifics.
Acceptable Use
We trust our users to be reasonable. Please don't:
- Use Super44 for anything illegal or to harm others
- Attempt to reverse-engineer, scrape, or extract the AI model or its outputs at scale
- Share your account with others or create accounts on behalf of people who haven't agreed to these terms
- Deliberately feed the AI misleading data to generate false outputs
- Use the service in a way that disrupts it for other users
Intellectual Property
Super44 (the app, brand, and underlying technology) belongs to Super44 GmbH. Your use of the service doesn't transfer any ownership of our intellectual property to you. The AI-generated outputs based on your data are yours to use for your business purposes. We don't claim ownership over the insights Super44 generates from your data.
Limitation of Liability
We provide Super44 with reasonable care, but no software is perfect. Our liability is structured as follows:
- Unlimited liability: We are liable without limitation for damages caused by intent (Vorsatz), gross negligence (grobe Fahrlässigkeit), and for injury to life, body, or health.
- Essential obligations: If we breach an essential contractual obligation (wesentliche Vertragspflicht) through simple negligence, our liability is limited to the foreseeable, contract-typical damage. Essential contractual obligations are those whose fulfillment is a prerequisite for the proper performance of the contract and on whose compliance you may regularly rely.
- Liability cap: Our total aggregate liability is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim. For users on a free plan, our aggregate liability for simple negligence is limited to EUR 100.
- Otherwise excluded: Liability for simple negligence is excluded except as stated above.
- AI and third-party services: We are not liable for business decisions you make based on AI-generated suggestions, or for issues caused by third-party services (POS providers, Google, app stores). This does not affect the unlimited liability tier above.
Nothing in these terms limits liability under the German Product Liability Act (Produkthaftungsgesetz) or any other liability that cannot be excluded under German law. Each paragraph of this section is intended to be severable — if any part is found invalid, the remaining parts remain in full effect.
Termination
You can stop using Super44 and delete your account at any time through the app settings or by emailing hello@super44.ai. We may also suspend or terminate your account if you materially violate these terms, after giving you notice and a reasonable opportunity to fix the issue (unless the violation is severe enough to warrant immediate action). On termination, your right to use the service ends. Data deletion follows the timelines in our Privacy Policy.
Changes to These Terms
We may update these terms from time to time. When we do, we'll notify you via the app and/or email at least 30 days before the changes take effect. If you don't agree with the new terms, you can cancel your account before they take effect. For material changes, we'll ask for your explicit consent. If you don't consent, your existing terms remain in effect until you or we terminate the agreement.
Governing Law and Disputes
These terms are governed by the laws of the Federal Republic of Germany. If you're a consumer in the EU, you also retain the protection of any mandatory provisions of the law of your country of residence. For disputes, the courts of Bonn, Germany have jurisdiction — unless mandatory consumer protection rules in your country of residence require otherwise. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/odr.
